Separation of the parties
The parties agree that each has the right to withdraw from their Relationship at any time and, whilst each sincerely hopes that their Relationship will continue to grow over the years, should for any reason either decide to withdraw from the Relationship, the other accepts their right to do so and neither will endeavour by any court process or any means to investigate the merits of the behaviour of either of them or the reasons for the breakdown of their Relationship, and in particular:
- (a)the provisions of this Agreement as to the consequences of the final separation will apply regardless of any question of fault or conduct;

Is a BFA the same thing as a prenup?
“Prenup” is the everyday word and “Binding Financial Agreement” is the legal one. In Australia there is no separate instrument called a prenuptial agreement. A prenup is a financial agreement made before marriage under s 90B of the Family Law Act 1975 (Cth), which is exactly what myBFA drafts.
Is it really legally binding?
Yes, where the requirements of the Act are met. Each party has to receive independent legal advice from an Australian legal practitioner before signing, and a signed statement of that advice has to be given to the other party. That advice is built into the myBFA process rather than left for the two of you to arrange separately.
Why is it so much cheaper than a traditional firm?
Because the parts that do not need a lawyer are not done by one. You complete disclosure yourselves through the platform, the drafting is systematised, and the lawyers spend their time on advice and review, which are the parts that genuinely require them.
How long does the whole thing take?
